About Van Cleef & Arpels and these Conditions of Sale

These Conditions of Sale apply to any sales of Van Cleef & Arpels products or services that you may order from our Selling Entity (as defined below), using the website https://www.vancleefandarpels.com and any associated mobile or digital applications that refer to these Conditions of Sale (together, the “Platforms”) or by telephone via our client relations center (the “Client Relations Center”).

The Selling Entity, that will sell the products to you, will depend on the delivery address to which you will ship the products:

For purchases with delivery to addresses in Germany, the applicable Selling Entity is Richemont Northern Europe GmbH with registered offices at Landsberger Str. 302-306, 80687 Munich, Germany with VAT number DE 129 311 406;

For purchases with delivery to addresses in France, the applicable Selling Entity is Société Cartier with registered offices at 13 Rue de la Paix, 75002 Paris, France with VAT number CEE FR 36 775 658 859;

For purchases with delivery to addresses in the UK, the applicable Selling Entity is Richemont UK Limited, with registered office at 15 Hill Street, London W1J 5QT, UK with VAT number GB 238 5603 54; and

For purchases with delivery to addresses to all other countries that we ship to under our Shipping Policy, the applicable Selling Entity is RLG Europe BV, Amsterdam (NL), Swiss Branch, Villars sur Glâne with registered office at 10 Route des Biches, CH-1752 Villars-sur-Glâne 2, Switzerland with VAT number CHE-114.784.839,

(each of the above a “Selling Entity” and each “Van Cleef & Arpels” and "we", "us" and "our").]

The Selling Entity which owns and edits the Platforms pursuant to the Terms of Use is responsible for our information collection practices pursuant to the terms of the Privacy Policy. By placing an order, you agree to be bound by the Terms of Use and Privacy Policy, the terms of which are incorporated into these Conditions of Sale.

Please read these Conditions of Sale carefully. These Conditions of Sale are applicable to any order placed through the Platforms or Client Relations Center (together the “Sales Channels”). Please note that before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions of Sale, then you will not be able to order any products or services through the Sales Channels. Sales concluded through physical points of sale (such as our retail boutiques) or third parties (such as authorized retailers) are not subject to these Conditions of Sale.

 

Updates to these Conditions of Sale

We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Conditions of Sale will always be available on the Platforms. Any new version of these Conditions of Sale shall take effect immediately upon the date of posting and will govern any orders of products or services made as from that date. Any changes to the Conditions of Sale made after you have placed an order will not affect that order and your relationship with us, except as may be required by applicable law.

 

Purchasing eligibility

Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most countries); (b) have legal capacity to enter into contracts; and (c) use a shipping address in the country or countries that we ship to as specified by the Sales Channels, may order products through the Sales Channels. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Conditions of Sale.

By placing an order through the Sales Channels, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes.

 

Product availability & quantity

All orders placed through the Sales Channels are subject to availability and acceptance of such orders by us. Products shown on the Platforms, which cannot be added to the shopping bag, are not available for sale via the Platforms. The Client Relations Center can provide more information as regards these products. For information about the order process, please refer to our Order Process section below.

Quantity limits may apply in relation to orders for certain products. We reserve the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

 

Account registration & guest checkout

To place an order, you may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. Where you place an order as a guest, we may still create an account on our internal systems to record your purchase(s).

In accordance with article L.223-2 of the Consumer Code, we inform you of your right to register on the “Bloctel” opt-out of cold calling list. For more information, we invite you to refer to our Privacy Policy. 

 

Personalized services

Personalization services (for example engraving) or other services may be available on a selection of products. If you wish to have your product personalized, please provide the details in the Sales Channels as requested.

We reserve the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that any wording you provide for personalizing products is correct.

In addition, orders for personalized products cannot be cancelled and such products that have been personalized in any way or otherwise made to your bespoke specifications cannot be returned to us for exchange or refund as described in these Conditions of Sale. This does not affect your consumer rights (please see the Manufacturer’s guarantee and your legal consumer rights section for further information).

 

Order Process

The order process of the Platforms will include the following:

·             Add to Shopping Bag: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits). Placing an item in your shopping bag does not guarantee availability for purchase, which is not confirmed until you receive a written Confirmation of Order & Shipment.

·             Guest/My Account Checkout: When you are ready, you then proceed to “Checkout”, either as a guest or through your registered account. You may also remove one or several products you have selected from the shopping bag as part of the checkout process.

·             Delivery, Review and Payment: As part of the checkout process, you add and review your order details and personal information (including e-mail, shipping address, billing address and payment information). You should carefully check and confirm all details on the order summary page before placing your order. 

·             Placing of Order: You then check the relevant box and place your order.

In the case of an order being placed through the Client Relations Center, the Van Cleef & Arpels ambassador will walk you through the steps above and verbally ask you to confirm the details of your order.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activities; or (ii) have otherwise violated these Conditions of Sale.

 

Prices, taxes and shipping costs

All prices shown on the product pages of the Platforms or quoted by the Client Relations Center include sales taxes/VAT but exclude shipping costs and other taxes unless otherwise stated.

The applicable currency will be updated based on the shipping destination after you provide us with the delivery address and will be shown in your shopping bag before you place your order. You should check updated prices and currency carefully.

Sales, use or other taxes will vary based on the location to which products are being shipped.

Shipping costs, if any, are described in the Shipping Policy below or on the Sales Channels. Shipping costs are not stated on the product pages but will be added to the product price after you have chosen your delivery options. These costs will be summarised before you are asked to confirm and place your order and will also be reflected in our email correspondence with you once you have chosen your delivery options.

We may offer a VAT refund mechanism if you decide to have the products delivered in certain countries of the European Union and, no longer than thirty (30) days afterwards, export them outside the European Union upon certain conditions. Such mechanism will not be available to European Economic Area customers. For details, please contact our Client Relations Center.

We reserve the right to modify prices and delivery costs at any time without prior notice.

We take reasonable care that the prices of products and delivery costs are correct at the time when the relevant information was entered into the system or communicated to you via the Client Relations Center. However, it is always possible that, despite our reasonable efforts, some of the products offered through our Sales Channels or delivery costs may be incorrectly priced. If any of the products you place an order for or any delivery costs are incorrectly priced, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you have provided during the order process, we will cancel the order and notify you in writing. If we mistakenly accept and process your order where a pricing or delivery cost error occurs, we may cancel supply of the product and refund you any sums you have paid.

Please note that changes to applicable law between the date your order is placed and the date you are sent a written Confirmation of Order & Shipment may result in changes to the taxes associated with your order. If the resulting change is an increase in the taxes that you are charged, we will contact you and ask that you reconfirm your order.

 

Payment

We accept the methods of payment identified as part of the order process via the Sales Channels. Depending upon the means of payment, we may require additional information, including specific forms of identification.

When ordering on the Platforms, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your complete payment details. All payment card holders are subject to validation check and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, you will need to contact your card issuer directly to solve this problem.

Other payment methods may also be subject to validation checks and authorization by the payment system providers as well. You expressly authorize us to perform security checks, where we deem necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your payment card details, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize individual purchase transactions.

The full amount of your purchase will typically be blocked on your payment card until your order is shipped, at which point you will be sent a Confirmation of Order & Shipment and your payment card will be charged the applicable purchase price.

Where we offer PayPal, Paypal Express, WeChat Pay or Alipay as a payment method, the full amount of your purchase may be debited on your payment card immediately following the placement of your order. Pre-payment shall not impact any of your legal rights under these Conditions of Sale (including for example any right of refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

We may accept bank wire transfer for orders at our sole discretion. We do not charge a fee for bank wire transfers for orders made through the Sales Channels or Client Relations Center, however, some financial institutions may charge a fee for using a bank wire transfer. We require that all bank wire transfer orders placed by telephone be confirmed through an order approval process. We may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by us by e-mail. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

 

Acknowledgement of Order

Once you have made your choice and your order has been placed through the Sales Channels, you will receive a written Acknowledgement of Order (by e-mail or otherwise confirming the details of your order together with an order reference number). Please make sure that you save this order reference number for any future enquiries regarding your order. This Acknowledgement of Order is not an acceptance of your order. To confirm the order, we will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. Upon receipt of the Acknowledgement of Order, it is your responsibility to review it and confirm that it accurately reflects your intended order.  If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact the Client Relations Center promptly. 

These Conditions of Sale will be provided to you when we acknowledge your order.

 

Shipping Policy

We only accept orders for delivery to the country or countries that are identified during the Order Process. Please note that we do not ship to certain addresses, such as military, certain restricted areas, pick-up points, or PO boxes. For further information, please contact the Client Relations Center.

Boutique pick-up may be offered, free of charge, to certain locations. Please refer to the Platforms or call the Client Relations Center for more information. We will inform you by e-mail or by telephone when the product is ready for pick-up at the boutique.

If you order several products, we will ship the order only once all products are available (there will be no partial shipments, unless otherwise communicated to you).

 

Confirmation of Order & Shipment

Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract.

 

Delivery

We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery lead time from the date of our written Confirmation of Order & Shipment and in any event within thirty (30) days after that date, except if your purchase relates to a product or service that we have explained to you will take additional time to deliver, for example in the case of products or services that we personalize or produce to your specifications.

When ordering through the Sales Channels, you may be able to choose a specific delivery date as available on the Sales Channels. Any such specific delivery date remains subject to our confirmation.

If delivery of products is delayed by an event outside our control, we will inform you as soon as possible and will use reasonable efforts to minimise the effect of the delay. If we do not deliver within thirty (30) days from the date of the written Confirmation of Order & Shipment or any other time limit as indicated by us, you may contact the Client Relations Center to cancel the relevant order and get a refund of any sums you pre-paid us for any products which you have not received.

In any event, your sole remedy for any failure by us to deliver the order to you shall be your right to cancel the relevant order and receive a refund of sums you pre-paid us for any products which you have not received.

When estimating your delivery time, please allow time for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receiving your full payment.

We will require a handwritten or electronic signature by you, or a person at the nominated delivery address (unless arranged by you otherwise), to confirm the delivery of each product, at which point risk and responsibility for your purchased goods passes to you.  If you have specified a recipient who is not you for delivery purposes (for example, as a gift), then you understand and accept that evidence of a signature by such recipient (or a person at the delivery address) is evidence of delivery and fulfilment of the sales contract by Van Cleef & Arpels and transfer of responsibility to the recipient in the same way as if the product had been delivered to you. We reserve the right to deliver products only to the person who is the intended recipient of the order as stated on the label of the parcel and to request ID check for verification purposes at the time of delivery for certain categories of products. Please call our Client Relations Center for more information.

 

Invoices

When ordering products via the Sales Channels, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise).

 

Returns and Exchanges

(a)    Right to Cancel

You have the right to cancel the contract created by our written order confirmation without giving any reason thirty (30) days from the day on which you acquire, or someone you nominate (other than the carrier) acquires, physical possession of the products in your order.  Note that this right to cancel the contract within 30 days is specific for the E-Boutique. If you are a customer based in the European Union or the European Economic Area and have made a purchase via the Sales Channels, this is considered to be your statutory right to withdraw from the contract. To meet the withdrawal deadline, it is sufficient for you to withdraw before the withdrawal period has expired.   

To cancel the contract and return your product(s), you can contact our Client Relations Center and follow the instructions that will be given to you, or you can send us in writing an unequivocal statement such as a letter or e-mail to: Van Cleef & Arpels, Van Cleef & Arpels, Client Relations Centre, RLG Europe BV, PO Box 2967, NL-1000 CZ, Amsterdam or client.relations.europe@vancleefarpels.com. Alternatively, you may cancel using the Model Cancellation Form, but it is not obligatory.

(b)   Return Process

Products that have been purchased through the Sales Channels may only be returned to our Van Cleef & Arpels e-boutique distribution center at the address of our Returns Department, as provided through our Client Relations Center, or if available to selected Van Cleef & Arpels retail boutiques, in accordance with these Conditions of Sale.

Products that have not been purchased through the Sales Channels may NOT be returned to our e-boutique distribution center.

To return a product to our e-boutique distribution center, you must follow the steps mentioned below:

(i)               Call the Client Relations Center.

(ii)              You may use our pick-up service and agree on a pick-up date with our logistics partner. You may be asked at this stage to provide information about the product for us to make a first assessment of the condition of this product;

(iii)             The Client Relations Center will ask you to complete the return form that was enclosed with your product delivery;

(iv)             Please fill out the required information on the return form and sign it;

(v)              You must include in the delivery package, the completed return form along with the product, all its accessories, any free items you received as part of your order, the Service Guide, the warranty card and all other documents, in their original box;

(vi)             Please seal the delivery package and affix the pre-paid airway bill received with your purchase or sent to you via email by our Client Relations Center; and

(vii)           For our pick-up service, our logistics partner will pick-up the sealed delivery package on the agreed date.

You must keep a proof of return shipment and we accept no liability in the event that such proof cannot be produced. Only merchandise received by our Van Cleef & Arpels e-boutique distribution center will be eligible for a refund or exchange.

You may be able to return the product to a Van Cleef & Arpels retail boutique in the country where your product was delivered. Please call the Client Relations Center for further details and one of our client advisors will assist you to find the eligible boutiques. You may be asked to provide information about the products for us to make a first assessment of the condition of these products.

(c)    Condition of Returned Products

We will verify that the returned product satisfies the conditions of the Returns and Exchanges Policy and, if so, then proceed with the applicable refund or exchange.

Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Van Cleef & Arpels box and delivery package, including all accessories and documents. For example, timepiece bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. We reserve our right not to accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.

If you have received free items as part of your order, they must be returned with the products.

All returns will be subject to strict Quality Control (“QC”) by us to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, we will refuse the return, and the products will be returned to you. If the returned product satisfies QC, we will proceed with the applicable refund or exchange.

Failure to comply with these Conditions of Sale will entitle us to refuse the returned product and send it back to you, at your own cost.

(d)   Products you cannot return or exchange

Orders for products that have been personalized in any way or otherwise made for you with bespoke specifications cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes, without limitation, products that have been engraved.

Please note, fragrances are final sale and may not be returned.

(e)    Refunds

You may return a product purchased through the Sales Channels for refund, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above.

Only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Client Relations Center to discuss your options.

If the return complies with these Conditions of Sale, we will use commercially reasonable endeavours to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction within fourteen (14) days after receipt of the returned item by the Van Cleef & Arpels e-boutique distribution center. Initial shipping charges will be refunded, except where you had originally opted for a non-standard delivery, in which cases the supplemental costs will be non-refundable.

If you are returning a product purchased via the Sales Channels to a participating Van Cleef & Arpels retail boutique (please contact the Client Relations Center to find out about our participating Van Cleef & Arpels retail boutiques), you will only be entitled to receive, at your choice, a refund of the purchase price or a boutique merchandise credit. Boutique merchandise credits can only be applied to products purchased in a participating Van Cleef & Arpels retail boutique and cannot be applied to products purchased through the Sales Channels. Please contact the Client Relations Center for further details.

(f)     Exchanges

You may return a product purchased through the Sales Channels for exchange with another Van Cleef & Arpels product, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above. 

In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

Should a product be returned to the Van Cleef & Arpels e-boutique distribution center for exchange with a less expensive product, only the buyer of the returned product will be entitled to receive a refund of the price difference.

Should a product be returned for exchange to a participating Van Cleef & Arpels retail boutique for exchange (please [refer to our FAQs section or] contact the Client Relations Center to find out about our participating Van Cleef & Arpels retail boutiques) with a less expensive product, the individual making the return will only be entitled to receive a merchandise credit of the price difference. Boutique merchandise credits can only be applied to products purchased in a participating Van Cleef & Arpels retail boutique and cannot be applied to products purchased through the Sales Channels. Please contact the Client Relations Center for further details.

If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

 

Manufacturer’s guarantee and your legal consumer rights

We are committed to ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

Selected products are covered by the applicable Van Cleef & Arpels Guarantee. If you wish to repair a product covered by the applicable Van Cleef & Arpels Guarantee, please refer to the applicable Van Cleef & Arpels Guarantee, and call our Client Relations Center for more information.

In your capacity as consumer, you may have legal rights under the applicable law of governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale or the applicable Van Cleef & Arpels Guarantee.

 

Complimentary Services

The following complimentary services may be proposed, free of charge, by the Sales Channels:

(a)  Gift Wrap and Packaging

All orders will be shipped with the Van Cleef & Arpels box gift wrapped in Van Cleef & Arpels special packaging, together with a Van Cleef & Arpels shopping bag (where applicable).

(b)  Engravings

Engraving may be available on specific products.

If you wish to have your Van Cleef & Arpels product engraved, please provide the details to the Client Relations Center or, where available, specify accordingly on the Platforms.

Orders for personalized Van Cleef & Arpels products cannot be cancelled and personalized Van Cleef & Arpels products cannot be returned to Van Cleef & Arpels for exchange or refund.

(c)  Strap Exchange / Adjustment

A Van Cleef & Arpels watch strap is delivered in a standard size. The strap size can be delivered smaller or larger, upon request, by calling the Client Relations Center. Van Cleef & Arpels watch strap adjustment is also available on certain watch models. If you request a watch bracelet adjustment, the removed links will be returned to you and included in the delivery package.

(d)  Jewelry Adjustment / Alterations

For any adjustments or alterations to your Van Cleef & Arpels jewelry, please contact the Client Relations Center or check our website for further information and assistance.

(e) Gift Note

You may personalize your order by adding a personalized note that will be printed by Van Cleef & Arpels on a gift card to be included in your order package. Van Cleef & Arpels reserves the right to reject gift card notes it deems offensive or inappropriate to be sent on Van Cleef & Arpels-logo stationery.

 

Repairs

For any repair inquiries relating to a product ordered through the Sales Channels, please contact our Client Relations Center.

 

Limitation of liability

To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the products and Sales Channels whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law.  Subject to the preceding sentence, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed the one hundred percent (100%) of the price of the product(s) in your order.

Please note that in some jurisdictions consumer protection laws may not allow certain exclusions or limitation of warranties or liabilities, and consequently some of the above exclusions and limitations may not apply.

 

General provisions

If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Van Cleef & Arpels Guarantee.

 

Applicable law and jurisdiction

These Conditions of Sale shall be governed by and construed in accordance with the laws of the country in which the applicable Selling Entity has its registered office, without reference to conflict of laws provisions (“applicable laws”). Any dispute, controversy or claim arising out of or in relation to the Conditions of Sale, including the validity, invalidity, breach or termination of the Conditions of Sale, shall be adjudicated or arbitrated in accordance with the Conditions of Sale.  Where the applicable laws are different to the mandatory consumer laws in your own country, we will afford you with similar protection.

You may bring proceedings against us either in the courts of either in the courts of the country in which the applicable Selling Entity has its registered office or in the country where you are domiciled. We may also bring proceedings against you in the courts of the country where you are domiciled.

Without any restriction to bring proceedings before a court, you and Van Cleef & Arpels will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

If you are a consumer resident in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution entity. Customers purchasing products online or by phone through the Van Cleef & Arpels Client Relations Centre must read the Conditions of Sale, which will govern the terms and conditions of any such purchases. Whilst considerable effort has been made to ensure that the visual representations of Van Cleef & Arpels products displayed on the platforms are representative of the colour, design and style etc. of the original products, slight variations, distortions and/or differences may be apparent when compared to the original product. Accordingly, Van Cleef & Arpels cannot be held liable for any apparent differences in the product images represented on the Platforms and the original products. We strongly advise you visit one of our boutiques or authorised retailers prior to making a purchase online or by phone.

You may download one computer copy or print one copy of the material made available to you via the Platforms, or download the application on to your mobile device, for your own non-commercial, educational, private or domestic use only, provided that proprietary notices, in particular intellectual property notices such as copyright©, trademark™, are preserved intact and are not modified, deleted or changed. To this end, it possesses its own sources of creativity, in particular highly skilled teams of designers who conceive and perfect Van Cleef & Arpels’ creations. As a result, Van Cleef & Arpels cannot agree to or accept to be the receiver of unsolicited proposals of collaboration. Indeed, it is conceivable that Van Cleef & Arpels may already be working on similar ideas and/or creations. Consequently, you are advised that Van Cleef & Arpels is not interested in receiving ideas or other proposals relating to creations you may wish to submit.

 

Limitation of liability

 

This section applies to the Platforms and not to the products that may be sold online or by phone by one of our local or regional markets.

You agree that Van Cleef & Arpels may terminate or suspend your access to and use of the Platforms if Van Cleef & Arpels  reasonably believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Use, or violated the rights of Van Cleef & Arpels, its affiliated companies or any third party, with or without notice to you. You agree that Van Cleef & Arpels may modify or discontinue providing any of the Platforms, with or without notice to you. You agree that Van Cleef & Arpels will not be liable to you or any third party as a result of such modification or discontinuation. The provisions entitled "Limitation of liability" and "General provisions" will survive termination of these Terms of Use.

 

General provisions

 

Unless otherwise specified, the information and materials presented on the Platforms are presented solely for the purpose of promoting Van Cleef & Arpels’s products and services and in certain cases to present products for sale via a variety of means. Van Cleef & Arpels makes no representation that Van Cleef & Arpels Material is appropriate or available for use in every country of the world. You are responsible for compliance with applicable local laws, keeping in mind that access to Van Cleef & Arpels Material may not be legal by certain persons or in certain countries. Our products are available in many parts of the world. However, the Platforms may identify products that are not available worldwide.

If any provision, or part of a provision, of these Terms of Use is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Terms of Use, and the legality, validity or enforceability of the remainder of the provisions of these Terms of Use shall not be affected, unless otherwise required by operation of applicable law.

These Terms of Use constitute the entire agreement between you and us in relation to the use of the Platform, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

The waiver by Van Cleef & Arpels of a breach of any provision of these Terms of Use will not operate to be interpreted as a waiver of any other or subsequent breach.

 

Applicable law and jurisdiction

 

These Terms of Use shall be governed by and construed in accordance with the laws of Switzerland, without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or in relation to the Terms of Use, including the validity, invalidity, breach or termination thereof, shall be adjudicated or arbitrated in accordance with said Terms of Use.  Where the laws of Switzerland are different to the mandatory consumer laws in your own country, we will afford you with similar protection.

About Van Cleef & Arpels and these Conditions of Sale

These Conditions of Sale apply to any sales of Van Cleef & Arpels products or services that you may order from SC by e-mail or phone at a distance or during an event outside a Van Cleef & Arpels Boutique via the relevant retail boutique of Van Cleef & Arpels (together the “Van Cleef & Arpels Boutique”).

SC has its registered offices at 13 rue de la paix 75002 PARIS (Van Cleef & Arpels and "we", "us" and "our"). Our VAT number is FR 36 775 658 859.

In addition, our information collection practices and the ways in which we may use and protect that information, are further set out in our Privacy Policy. Persons wishing to use the Van Cleef & Arpels Boutique will also be deemed, by virtue of such use, to have agreed to be bound by the Privacy Policy, which are incorporated into these Conditions of Sale by reference (and are available here: Legal - Van Cleef & Arpels). By placing an order, you agree to be bound by the Privacy Policy, the terms of which are incorporated into these Conditions of Sale.

Please read these Conditions of Sale carefully. These Conditions of Sale are applicable to any order placed through the Van Cleef & Arpels Boutique. Please note that before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions of Sale, then you will not be able to order any products or services through the Van Cleef & Arpels Boutique. Sales concluded in person through physical points of sale (such as our retail boutiques) or third parties (such as authorized retailers) are not subject to these Conditions of Sale.

 

Updates to these Conditions of Sale

We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Conditions of Sale will always be available on request.

Any changes to the Conditions of Sale made after you have placed an order will not affect that order and your relationship with us, except as may be required by applicable law.

 

 

 

Purchasing eligibility

Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most countries); (b) have legal capacity to enter into contracts; and (c) use a shipping address in the country or countries that we ship to as specified by the Van Cleef & Arpels Boutique, may order products through the Van Cleef & Arpels Boutique. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Conditions of Sale.

By placing an order through the Van Cleef & Arpels Boutique, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes.

Product availability & quantity

All orders placed through the Van Cleef & Arpels Boutique are subject to availability and acceptance of such orders by us. The Van Cleef & Arpels Boutique can provide more information as regards these products. For information about the order process, please refer to our Order Process section below.

Quantity limits may apply in relation to orders for certain products. We reserve the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

Personalized services

Personalization services (for example engraving or embossing) or other services may be available on a selection of products. If you wish to have your product personalized, please provide the details in the Van Cleef & Arpels Boutique as requested.

We reserve the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that any wording you provide for personalizing products is correct.

In addition, orders for personalized products cannot be cancelled and such products that have been personalized in any way or otherwise made to your bespoke specifications cannot be returned to us for exchange or refund as described in these Conditions of Sale. This does not affect your consumer rights (please see the Manufacturer’s guarantee and your legal consumer rights section for further information).

Order Process

For orders being placed through the Van Cleef & Arpels Boutique, the Van Cleef & Arpels Sales Associate will walk you through the steps above and verbally ask you to confirm the details of your order.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activities; or (ii) have otherwise violated these Conditions of Sale. 

Prices, taxes and shipping costs

All prices quoted by the Van Cleef & Arpels Boutique include sales taxes/VAT but exclude shipping costs and other taxes unless otherwise stated.

The applicable currency will be updated based on the shipping destination after you provide us with the delivery address and will be shown in your shopping bag before you place your order. You should check updated prices and currency carefully.

Sales, use or other taxes will vary based on the location to which products are being shipped.

Shipping costs, if any, are described in the Shipping Policy below or by the Van Cleef & Arpels Boutique. Shipping costs are not stated on the product pages but will be added to the product price after you have chosen your delivery options. These costs will be summarized before you are asked to confirm and place your order and will also be reflected in our email correspondence with you once you have chosen your delivery options.

We reserve the right to modify prices and delivery costs at any time without prior notice.

We take reasonable care that the prices of products and delivery costs are correct at the time when the relevant information was entered into the system or communicated to you via the Van Cleef & Arpels Boutique. However, it is always possible that, despite our reasonable efforts, some of the products offered through our Van Cleef & Arpels Boutique or delivery costs may be incorrectly priced. If any of the products you place an order for or any delivery costs are incorrectly priced, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you have provided during the order process, we will cancel the order and notify you in writing. If we mistakenly accept and process your order where a pricing or delivery cost error occurs, we may cancel supply of the product and refund you any sums you have paid.

Payment

We accept the methods of payment identified as part of the order process via the Van Cleef & Arpels Boutique. Depending upon the means of payment, we may require additional information, including specific forms of identification.

We offer you the ability to prepay for your products, either as a full prepayment or a partial prepayment. Where we offer partial prepayment as an advance payment method, the partial prepayment will be taken immediately following the placement of your order and, due to the nature of the products, the partial prepayment will represent a minimum of 30% of the retail cost of the product. We will reserve your product for a maximum of 3 months from the date of payment, or for any such longer period that may be communicated to you for special cases (including but not limited to personalized, bespoke, unique or limited edition products etc.), after which we reserve the right to sell the reserved product. Prepayments (in whole or in part) are non-refundable. However, prepayments shall not impact any of your legal rights under these Conditions of Sale (including for example any right of withdrawal and/or refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the prepayment without undue delay.

When ordering using our Pay-by-Link process, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Van Cleef & Arpels Boutique your complete payment details. All payment card holders are subject to validation check and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, you will need to contact your card issuer directly to solve this problem.

Other payment methods may also be subject to validation checks and authorization by the payment system providers as well. You expressly authorize us to perform security checks, where we deem necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your payment card details, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize individual purchase transactions.

Acknowledgement of Order

Once you have made your choice and your order has been placed through the Van Cleef & Arpels Boutique, you will receive a written Acknowledgement of Order (by e-mail or otherwise confirming the details of your order together with an order reference number). Please make sure that you save this order reference number for any future enquiries regarding your order. This Acknowledgement of Order is not an acceptance of your order. To confirm the order, we will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. Upon receipt of the Acknowledgement of Order, it is your responsibility to review it and confirm that it accurately reflects your intended order.  If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact the Van Cleef & Arpels Boutique promptly. 

These Conditions of Sale will be provided to you when we acknowledge your order.

 

 

 

 

 

Shipping Policy

We only accept orders for delivery to the country or countries that are identified during the Order Process. Please note that we do not ship to certain addresses, such as military, certain restricted areas, pick-up points, or PO boxes. For further information, please contact the Van Cleef & Arpels Boutique.

Boutique pick-up may be offered, free of charge, to certain locations. We will inform you by e-mail or by telephone when the product is ready for pick-up at the boutique.

If you order several products, we will ship the order only once all products are available (there will be no partial shipments, unless otherwise communicated to you).

Confirmation of Order & Shipment

Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract.

Delivery

We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery lead time from the date of our written Confirmation of Order & Shipment and in any event within thirty (30) days after that date, except if your purchase relates to a product or service that we have explained to you will take additional time to deliver, for example in the case of products or services that we personalize or produce to your specifications.

When ordering through the Van Cleef & Arpels Boutique, you may be able to choose a specific delivery date as available on the Van Cleef & Arpels Boutique. Any such specific delivery date remains subject to our confirmation.

If delivery of products is delayed by an event outside our control, we will inform you as soon as possible and will use reasonable efforts to minimize the effect of the delay. If we do not deliver within thirty (30) days from the date of the written Confirmation of Order & Shipment or any other time limit as indicated by us, you may contact the Van Cleef & Arpels Boutique to cancel the relevant order and get a refund of any sums you pre-paid us for any products which you have not received. 

In any event, your sole remedy for any failure by us to deliver the order to you shall be your right to cancel the relevant order and receive a refund of sums you pre-paid us for any products which you have not received.

When estimating your delivery time, please allow time for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receiving your full payment.

We will require a handwritten or electronic signature by you, or a person at the nominated delivery address (unless arranged by you otherwise), to confirm the delivery of each product, at which point risk and responsibility for your purchased goods passes to you.  If you have specified a recipient who is not you for delivery purposes (for example, as a gift), then you understand and accept that evidence of a signature by such recipient (or a person at the delivery address) is evidence of delivery and fulfilment of the sales contract by Van Cleef & Arpels and transfer of responsibility to the recipient in the same way as if the product had been delivered to you. We reserve the right to deliver products only to the person who is the intended recipient of the order as stated on the label of the parcel and to request ID check for verification purposes at the time of delivery for certain categories of products.

 

Invoices

When ordering products via the Van Cleef & Arpels Boutique, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise).

Returns and Exchanges

(a) Right to Cancel

You have the right to cancel the contract created by our written order confirmation without giving any reason thirty (30) days from the day on which you acquire, or someone you nominate (other than the carrier) acquires, physical possession of the products in your order.  If you are a customer based in the European Union or the European Economic Area and have made a purchase via the Van Cleef & Arpels Boutique, this is considered to be your statutory right to withdraw from the contract. To meet the withdrawal deadline, it is sufficient for you to withdraw before the withdrawal period has expired.  

To cancel the contract and return your product(s), you can contact our Van Cleef & Arpels Boutique and follow the instructions that will be given to you, or you can send us in writing an unequivocal statement such as a letter or e-mail to any address provided at the end of these Conditions of Sale, . Alternatively, you may cancel using the Model Cancellation Form, but it is not obligatory.

(b) Return Process

To return a product to a Van Cleef & Arpels retail boutique, please call the Van Cleef & Arpels Boutique for details of their returns process (first to confirm the appointment with your selected Van Cleef & Arpels retail boutique). You may be asked to provide photos of the products for us to make a first assessment of the condition of these products.

(c) Condition of Returned Products

We will verify that the returned product satisfies the conditions of the Returns and Exchanges Policy and, if so, then proceed with the applicable refund or exchange.

Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Van Cleef & Arpels box and delivery package, including all accessories and documents. For example, timepiece bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. We reserve our right not to accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.

If you have received free items as part of your order, they must be returned with the products.

All returns will be subject to strict Quality Control (“QC”) by us to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, we will refuse the return, and the products will be returned to you. If the returned product satisfies QC, we will proceed with the applicable refund or exchange.

Failure to comply with these Conditions of Sale will entitle us to refuse the returned product and send it back to you, at your own cost.

(d) Products you cannot return or exchange

Orders for products that have been personalized in any way or otherwise made for you with bespoke specifications cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes, without limitation, products that have been engraved or embossed.

(e) Refunds

You may return a product purchased through the Van Cleef & Arpels Boutique for refund, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above.

Only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Van Cleef & Arpels Boutique to discuss your options.

If the return complies with these Conditions of Sale, we will use commercially reasonable endeavours to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction within fourteen (14) days after receipt of the returned item by the Van Cleef & Arpels Boutique. Initial shipping charges will be refunded, except where you had originally opted for a non-standard delivery, in which cases the supplemental costs will be non-refundable.

(f) Exchanges

You may return a product purchased through the Van Cleef & Arpels Boutique for exchange with another Van Cleef & Arpels product, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above. 

In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

Should a product be returned to the Van Cleef & Arpels Boutique for exchange with a less expensive product, only the buyer of the returned product will be entitled to receive a refund of the price difference.

If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

Manufacturer’s guarantee and your legal consumer rights

We are committed to ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

Selected products are covered by the applicable Van Cleef & Arpels Guarantee. If you wish to repair a product covered by the applicable Van Cleef & Arpels Guarantee, please refer to the applicable Van Cleef & Arpels Guarantee, and call our Van Cleef & Arpels Boutique for more information.

In your capacity as consumer, you may have legal rights under the applicable law of governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale or the applicable Van Cleef & Arpels Guarantee.

Complimentary Services

The following complimentary services will be proposed, free of charge, by the Van Cleef & Arpels Boutique

 (a) Gift Wrap and Packaging

All orders will be shipped with the Van Cleef & Arpels box gift wrapped in Van Cleef & Arpels special packaging, together with a Van Cleef & Arpels shopping bag (where applicable).

(b) Engravings / Embossing

Engraving and embossing may be available on specific products, and offered only through sales transactions completed through the Van Cleef & Arpels Boutique.

If you wish to have your Van Cleef & Arpels product engraved or embossed, please provide the details to the Van Cleef & Arpels Boutique.

Orders for personalized Van Cleef & Arpels products cannot be cancelled and personalized Van Cleef & Arpels products cannot be returned to Van Cleef & Arpels for exchange or refund.

(c) Strap Exchange / Adjustment

A Van Cleef & Arpels watch strap is delivered in a standard size. The strap size can be delivered smaller or larger, upon request, by calling the Van Cleef & Arpels Boutique. Van Cleef & Arpels watch strap adjustment is also available on certain watch models. If you request a watch bracelet adjustment, the removed links will be returned to you and included in the delivery package.

(d) Gift Note

You may personalize your order by adding a personalized note that will be printed by Van Cleef & Arpels on a gift card to be included in your order package. Van Cleef & Arpels reserves the right to reject gift card notes it deems offensive or inappropriate to be sent on Van Cleef & Arpels -logo stationery.

Repairs

For any repair inquiries relating to a product ordered through the Van Cleef & Arpels Boutique, please contact our Van Cleef & Arpels Boutique.

Limitation of liability

To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the products and  Van Cleef & Arpels Boutique whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law.  Subject to the preceding sentence,  our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed the one hundred percent (100%) of the price of the product(s) in your order.

Please note that in some jurisdictions consumer protection laws may not allow certain exclusions or limitation of warranties or liabilities, and consequently some of the above exclusions and limitations may not apply.

General provisions

If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Van Cleef & Arpels Guarantee.

Without any restriction to bring proceedings before a court, you and Van Cleef & Arpels will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

If you are a consumer resident in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution entity. Les présentes Conditions de Vente s’appliquent à toutes ventes de produits ou services Van Cleef & Arpels que vous pouvez commander auprès de RLG Monaco par email ou par téléphone à distance ou lors d’un événement ayant lieu en dehors d’une boutique Van Cleef & Arpels via la boutique Van Cleef & Arpels rattachée à cet événement (ensemble la “Boutique Van Cleef & Arpels”).

La société RLG Monaco, immatriculée au RCI de Monaco sous le numéro 56S00041, (ci-après « Van Cleef & Arpels », et « nous », « nous-mêmes » et « notre ») a son siège social sis Place du Casino, 98 000 Monaco. Notre numéro de TVA est le suivant : FR 11000014000.

Nos pratiques de collecte de données et la façon dont nous pouvons utiliser et protéger ces données sont développées dans notre Politique de Confidentialité. Les personnes souhaitant utiliser l’intermédiaire de la Boutique Van Cleef & Arpels seront également réputés, en vertu d’une telle utilisation, avoir accepté d’être liées contractuellement par la Politique de Confidentialité, laquelle est incorporée aux présentes Conditions de Vente par référence (et est disponible ici : https://www.vancleefarpels.com/eu/fr/others/legal-page.html).  En passant commande, vous acceptez d’être lié par la Politique de Confidentialité, dont les conditions font partie intégrante des présentes Conditions de Vente.

Ces Conditions de Vente s’appliquent à toute commande passée par l’intermédiaire de la Boutique Van Cleef & Arpels. Veuillez noter qu’avant de commander des produits ou services, il vous sera demandé d’accepter les présentes Conditions de Vente. Si vous n’acceptez pas les présentes Conditions de Vente, vous ne serez pas en mesure de commander un quelconque produit ou service par l’intermédiaire de la Boutique Van Cleef & Arpels. Les ventes conclues en personne dans des points de vente physiques (tels que nos boutiques en propre) ou par l’intermédiaire de tiers (tels que des revendeurs agréés) ne sont pas soumises aux présentes Conditions de Vente.
 

Mise à jour des présentes Conditions de Vente

Nous pouvons modifier les présentes Conditions de Ventes à tout moment. Par conséquent, veuillez les vérifier régulièrement afin d’être tenu informé des mises à jour. La dernière version des présentes Conditions de Vente sera toujours disponible sur demande. Toutes modifications apportées aux Conditions de Vente après que vous ayez passé commande n’affecteront pas ladite commande ni votre relation avec nous, sauf si la loi en vigueur l’exige.

Eligibilité à l’Achat

Seules les personnes physiques (et non les personnes morales) qui (a) ont atteint l’âge de la majorité légale requise pour conclure des contrats (dix-huit ans dans la plupart des pays) ; b) jouissent de  la capacité légale de conclure des contrats ; et c) utilisent une adresse d’expédition dans le(s) pays que nous desservons, comme spécifié par la Boutique Van Cleef & Arpels, peuvent commander des produits par l’intermédiaire de la  Boutique Van Cleef & Arpels. Si vous n’avez pas atteint l’âge de la majorité légale ou si pour une quelconque autre raison vous ne jouissez pas de la capacité légale de conclure un contrat, l’un de vos parents ou votre tuteur devra passer la commande en votre nom et il lui sera demandé d’accepter les présentes Conditions de Vente.

En passant commande par l’intermédiaire de la Boutique Van Cleef & Arpels, vous déclarez et garantissez être un client et utilisateur final de bonne foi effectuant un achat pour votre usage personnel ou celui d’un tiers et que vous ne livrerez pas, ne vendrez pas ou ne distribuerez pas de toute autre manière nos produits, ni n’achèterez nos produits ou services à des fins commerciales.

Disponibilité & quantité des produits

Toutes les commandes passées par l’intermédiaire de la Boutique Van Cleef & Arpels sont sous réserve de disponibilité des produits et de notre acceptation desdites commandes. La Boutique Van Cleef & Arpels peut fournir de plus amples renseignements concernant ses produits. Pour toute information concernant le processus d’une commande, veuillez consulter notre section « Processus de Commande » ci-dessous.

Des limites de quantité peuvent s’appliquer aux commandes de certains produits. Nous nous réservons le droit de refuser à tout moment, sans préavis, des commandes dépassant un certain nombre de produits autorisés.

Services Personnalisés

Des services de personnalisation (par exemple, de gravure ou d’embossage) ou d’autres services peuvent être disponibles sur une sélection de produits. Si vous souhaitez faire personnaliser votre produit, veuillez fournir les détails dans la Boutique Van Cleef & Arpels comme demandé.

Nous nous réservons le droit de retenir ou de refuser l’acceptation de toute commande de produits personnalisés, ou accompagnée d’une carte message contenant des propos inacceptables, illégaux ou contraires à nos politiques. Vous êtes responsable de l’exactitude de toute mention que vous fournissez concernant les produits à personnaliser.

En outre, les commandes de produits personnalisés ne sont pas annulables et les produits qui ont été personnalisés, d’une manière ou d’une autre selon vos spécifications, ne peuvent nous être retournés en vue d’un échange ou d’un remboursement, tel que décrit dans les présentes Conditions de Vente. Cette clause n’affecte pas vos droits de consommateur (veuillez consulter l’article « Garantie du Fabricant et vos droits légaux en tant que consommateur » pour plus d’informations).

Processus de Commande

Pour toute commande passée par l’intermédiaire de la Boutique Van Cleef & Arpels, un ambassadeur Van Cleef & Arpels vous guidera tout au long des étapes et vous demandera de confirmer par mail les détails de votre commande.

Nous nous réservons le droit, à notre seule discrétion, de refuser, d’annuler ou de résilier des commandes à tout moment pour des motifs raisonnables. Par exemple, nous pouvons refuser, annuler ou résilier votre commande en cas de litige en cours concernant le paiement d’une précédente commande ou si nous vous soupçonnons, à notre seule discrétion, (i) d’activités frauduleuses ; ou (ii) de toute autre sorte de violation des présentes Conditions de Vente.

Prix, Taxes & Frais de livraison

Tous les prix indiqués par la Boutique Van Cleef & Arpels incluent les taxes de vente (TVA) mais excluent les frais de livraison et toutes autres taxes, sauf stipulation contraire.

La devise applicable sera l’Euro.

Les taxes de vente, d’utilisation ou autres taxes varieront selon le lieu de livraison des produits.

Les frais de livraison, le cas échéant, sont décrits dans la Politique d’Expédition ci-après ou par la Boutique Van Cleef & Arpels. Les frais de livraison ne sont pas indiqués sur les pages produits mais seront ajoutés au prix du produit après avoir choisi vos options de livraison. Un récapitulatif de ces frais sera fourni avant qu’il ne vous soit demandé de confirmer et de passer votre commande. Ces frais figureront également dans les emails que nous échangerons avec vous une fois que vous aurez choisi vos options de livraison.

Nous nous réservons le droit de modifier les prix et les frais de livraison à tout moment sans préavis.

Nous veillons à ce que les prix des produits et les frais de livraison soient corrects au moment où les informations pertinentes ont été saisies dans le système ou vous ont été communiquées via la Boutique Van Cleef & Arpels. Cependant, malgré les efforts raisonnables que nous déployons, il est toujours possible que le prix de certains des produits proposés par l’intermédiaire de notre boutique Van Cleef & Arpels ou les frais de livraison ne soient pas exacts. Si le prix de l’un des produits que vous commandez ou si les frais de livraison sont inexacts, nous vous contacterons dès que possible pour vous informer de cette erreur. Si nous ne sommes pas en mesure de vous contacter en utilisant les coordonnées que vous avez fournies pendant le processus de commande, nous annulerons la commande et vous en informerons par écrit. Si nous acceptons votre commande par erreur et la traitons alors qu’une erreur se produit au niveau des tarifs indiqués ou des frais de livraison, nous pouvons annuler la fourniture du produit et vous rembourser les sommes que vous avez versées.

Paiement

Nous acceptons les moyens de paiement identifiés dans le cadre du processus de commande via la Boutique Van Cleef & Arpels. En fonction des moyens de paiement, nous pouvons demander des informations supplémentaires, y compris toute forme d’identification particulière.

Nous vous offrons la possibilité de régler par anticipation vos produits soit intégralement soit partiellement. Le prépaiement sera débité immédiatement après avoir passé votre commande. Dans le cas d’un prépaiement partiel, celui-ci devra représenter un minimum de 30% du prix de vente du produit. Nous réserverons votre produit pour un délai de trois (3) mois maximum à compter de la date de paiement, ou pour tout délai plus long qui pourrait vous être communiqué pour des cas particuliers (y compris, mais sans s'y limiter aux produits personnalisés, sur mesure, uniques ou aux éditions limitées, etc.). Suite à ce délai nous nous réservons le droit de vendre le produit réservé. Les prépaiements (en tout ou en partie) ne sont pas remboursables. Cependant, les prépaiements n’affectent en rien vos droits indiqués dans les présentes Conditions de Vente (y compris par exemple tout droit de rétractation et/ou de remboursement).Si nous ne sommes pas en mesure de respecter nos obligations en matière d’expédition et/ou de livraison telles qu’indiquées ci-dessous, nous vous en informerons par e-mail et vous rembourserons le prépaiement dans les meilleurs délais.

Dans le cas d’une commande utilisant notre processus Pay-by-Link, vous devrez entrer vos coordonnées de paiement sur le formulaire approprié. Dans le cas d’une commande passée par téléphone, vous devrez communiquer à la Boutique Van Cleef & Arpels vos coordonnées de paiement complètes. Tous les titulaires de cartes de paiement sont soumis à un contrôle de validation et à une procédure d’autorisation de l’émetteur de la carte. Si l’émetteur de votre carte de paiement refuse d’autoriser le paiement en notre faveur, vous devrez contacter directement celui-ci pour résoudre le problème.

D’autres moyens de paiement peuvent également être soumis à des contrôles de validation et à une procédure d’autorisation par les fournisseurs du système de paiement. Vous nous autorisez expressément à exécuter les contrôles de sécurité lorsque nous le jugeons nécessaire, à transmettre ou obtenir des informations (y compris des informations mises à jour) vous concernant à l’intention ou provenant de tiers, y compris mais sans s’y limiter, les coordonnées de votre carte de paiement, afin d’authentifier votre identité, de valider votre carte de paiement, d’obtenir une autorisation initiale de carte de paiement et d’autoriser des transactions individuelles d’achat.

Accusé de réception de commande

Une fois que vous avez fait votre choix et passé votre commande par l’intermédiaire de la Boutique Van Cleef & Arpels, vous recevrez un Accusé de réception de commande écrit (par e-mail ou autrement, confirmant les détails de votre commande ainsi qu’un numéro de référence de commande). Prenez soin de bien conserver ce numéro de référence de commande, pour toute demande ultérieure concernant votre commande. Cet Accusé de réception de commande ne vaut pas acceptation de votre commande. Pour confirmer votre commande, nous réaliserons des contrôles juridiques habituels en matière de crédit, de lutte contre la fraude et de sécurité ainsi que des contrôles connexes et, s’ils sont satisfaisants, nous traiterons alors votre commande. À réception de l’Accusé de réception de commande, il est de votre responsabilité de le vérifier et de confirmer qu’il reflète précisément vos intentions de commande. Si vous avez des questions ou inquiétudes ou si l’Accusé de réception de commande ne reflète pas vos intentions, prenez rapidement contact avec la Boutique Van Cleef & Arpels.

Les présentes Conditions de Vente vous seront remises dès que nous accuserons réception de votre commande.

Politique d’Expédition

Nous n’acceptons que les commandes à livrer vers le(s) pays identifié(s) lors du Processus de Commande. Au sein de l’Union Européenne, il nous est impossible de livrer un produit en dehors du pays dans lequel la commande a été passée. Veuillez noter que nous n’expédions pas vers certaines adresses, telles que les zones militaires, certaines zones restreintes, les points de retrait ou les boîtes postales. Pour de plus amples renseignements, veuillez contacter la Boutique Van Cleef & Arpels.

Le retrait en boutique peut être proposé, gratuitement, à certains endroits. Nous vous informerons par e-mail ou par téléphone lorsque le produit est prêt à être retiré en boutique.

Si vous commandez plusieurs produits, nous n’expédierons la commande qu’une fois que tous les produits seront disponibles (il n’y aura aucune livraison partielle, sauf information contraire qui vous aura été communiquée).

Veuillez également noter que nous n’expédions pas certains produits en dehors du territoire français, notamment, sans que cette liste soit limitative, les parfums et les lunettes.

Confirmation de Commande et d’Expédition

Lors de l’expédition de votre commande, nous vous adresserons une Confirmation de Commande et d’Expédition par écrit (par e-mail ou autrement). Cette Confirmation de Commande et d’Expédition vaut acceptation de votre commande de notre part et indique l’existence d’un contrat de vente ayant force obligatoire.

Livraison

Nous déploierons des efforts raisonnables afin de veiller à ce que la livraison soit réalisée par le transporteur dans les délais de livraison estimés à compter de la date de notre Confirmation écrite de Commande et d’Expédition, et dans tous les cas dans les trente (30) jours suivant cette date, sauf si votre achat concerne un produit ou un service qui nécessitera un délai de livraison supplémentaire comme nous vous l’avons expliqué, par exemple en cas de produits ou services que nous personnalisons ou fabriquons selon vos consignes.

Au moment de passer commande par l’intermédiaire de la Boutique Van Cleef & Arpels, vous avez la possibilité de choisir une date de livraison particulière en fonction des disponibilités de la Boutique Van Cleef & Arpels. Le cas échéant, ladite date de livraison particulière demeure soumise à notre confirmation.

Si la livraison de produits est retardée par un événement hors de notre contrôle, nous vous informerons dès que possible et emploierons tous nos efforts raisonnables afin de minimiser les conséquences du retard. Si nous ne livrons pas dans les trente (30) jours suivant la date de la Confirmation écrite de Commande et d’Expédition ou tout autre délai indiqué par nos soins, vous pouvez contacter la Boutique Van Cleef & Arpels pour annuler la commande correspondante et obtenir un remboursement des sommes que vous nous avez versées en acompte au titre de tous produits que vous n’avez pas reçus.

Dans tous les cas, votre droit d'annuler une commande et de recevoir un remboursement des sommes que vous nous avez versées en acompte au titre de tous produits que vous n’avez pas reçus constitue votre unique recours si nous ne livrons pas la commande en question.

Le délai de livraison doit tenir compte des vérifications et contrôles (délai d’approbation du paiement, vérification d’adresse, contrôles de sécurité, traitement de commande) que nous devrons effectuer dans le cadre du règlement. Veuillez également noter que la livraison est toujours soumise à la réception de votre paiement intégral.

Veuillez également noter qu’un délai supplémentaire est à prévoir dans le cas de l’achat d’un bien culturel, tel que défini par la réglementation en vigueur, lequel est soumis au respect préalable de formalités légales spécifiques.

Nous exigerons une signature manuscrite ou électronique de votre part, ou de la part de toute personne à l’adresse de livraison indiquée (sauf si vous prenez d’autres dispositions), pour confirmer la livraison de chaque produit, après quoi le risque et la responsabilité des produits que vous avez achetés vous sont transférés. Si vous avez spécifié un destinataire autre que vous en vue de la livraison (par exemple s’il s’agit d’un cadeau), vous comprenez et acceptez qu’une signature dudit destinataire (ou d’une personne à l’adresse de livraison) constitue une preuve de livraison et d’exécution du contrat de vente par Van Cleef & Arpels, impliquant un transfert de responsabilité au destinataire, comme si le produit vous avait été livré en personne. Pour certaines catégories de produits, nous nous réservons le droit de livrer les produits uniquement à la personne qui est le destinataire visé de la commande comme indiqué sur l’étiquette du colis, et de demander un contrôle d’identité à des fins de vérification au moment de la livraison.

Factures

Après avoir commandé des produits via la Boutique Van Cleef & Arpels, vous recevrez une facture qui vous sera adressée par écrit (à votre adresse e-mail en pièce jointe au format PDF ou autrement).

Retours et échanges

(a)   Droit d’Annulation

Vous avez le droit d’annuler le contrat créé par notre confirmation de commande écrite sans donner de raison trente (30) jours à compter du lendemain de la date à laquelle vous acquérez, ou quelqu’un que vous nommez (autre que le transporteur) acquiert la possession physique des produits de votre commande. Si vous êtes un client situé dans l’Union Européenne ou dans l’Espace Economique Européen et que vous avez effectué un achat par l’intermédiaire de la Boutique Van Cleef & Arpels, ceci doit être considéré comme votre droit légal de rétractation. Afin de respecter le délai de rétractation, il vous suffit de vous rétracter avant l’expiration dudit délai.

Pour annuler le contrat et retourner votre produit, vous pouvez contacter notre Boutique Van Cleef & Arpels et suivre les instructions qui vous seront données. Vous pouvez également nous envoyer par écrit une déclaration sans équivoque, telle qu’une lettre à : Van Cleef & Arpels, 1 Place du Casino 98 000 Monaco. Alternativement, vous pouvez également annuler à l’aide du Modèle de Formulaire de rétractation, mais l’utilisation de ce formulaire n’est pas obligatoire

(b)   Processus de Retour

Pour retourner un produit, veuillez appeler la Boutique Van Cleef & Arpels pour plus de détails sur son processus de retour (d’abord pour confirmer le rendez-vous avec la boutique Van Cleef & Arpels sélectionnée). Il peut vous être demandé de fournir des photos des produits afin de nous permettre d’effectuer une première évaluation de l’état de ces produits.

(c)   Conditions de Retour de Produits

Nous vérifierons que le produit retourné remplit les conditions de la Politique de Retours et d’Echanges et, si tel est le cas, nous procéderons au remboursement ou à l’échange correspondant.

Nos produits doivent être retournés dans un état neuf et intact, en parfait état, munis de tous les matériaux de protection en place et accompagnés des étiquettes et autocollants qui y sont apposés (le cas échéant), ainsi que de la boîte Van Cleef & Arpels et de l’emballage d’origine, incluant l’intégralité des accessoires et documents. Par exemple, les bracelets de montre qui ont été réglés à votre demande doivent être retournés avec exactement le même nombre de maillons que dans l’emballage d’origine. Nous nous réservons le droit de ne pas accepter un quelconque retour si le produit présente des signes d’usure, ou a été utilisé ou altéré par rapport à son état d’origine de quelque manière que ce soit ou, de façon alternative, nous pouvons réduire le montant de tout remboursement ou échange applicable en conséquence.

Si vous avez reçu des articles gratuits dans le cadre de votre commande, ils doivent être retournés avec les produits.

Tous les retours seront soumis par nos soins à un Contrôle Qualité (« CQ ») rigoureux afin de s’assurer que les produits retournés sont conformes à ces exigences de qualité. Si les produits ne satisfont pas aux normes CQ, nous refuserons le retour, et les produits vous seront retournés. Si le produit retourné satisfait aux normes CQ, nous procéderons au remboursement ou à l’échange correspondant.

Le non-respect des présentes Conditions de Vente nous donnera le droit de refuser le produit retourné et de vous le renvoyer, à vos frais.

(d)   Produits non échangeables et non remboursables

Les commandes de produits qui, d’une manière ou d’une autre, ont été personnalisés sur mesure pour vous ne peuvent pas être annulées et lesdits produits ne peuvent pas nous être retournés en vue d’un échange ou d’un remboursement. Cela comprend, sans limitation, les produits qui ont été gravés ou embossés.

(e)   Remboursements

Vous pouvez retourner un produit acheté par l’intermédiaire de la Boutique Van Cleef & Arpels pour obtenir un remboursement, sous réserve que le retour soit conforme aux présentes Conditions de Vente, en particulier avec (a) le Droit d’Annulation et (b) le Processus de Retour ci-dessus.

Seul l’acheteur sera habilité à recevoir un remboursement du prix d’achat. En aucun cas une personne ayant reçu le produit en cadeau (c.-à-d. le « Destinataire d’un Cadeau ») ne sera habilité à recevoir un remboursement. Si vous êtes le Destinataire d’un Cadeau et souhaitez retourner un produit, veuillez contacter la Boutique Van Cleef & Arpels pour discuter de vos options.

Si le retour respecte les présentes Conditions de Vente, nous déploierons des efforts commercialement raisonnables afin de rembourser le prix d’achat à l’acheteur en utilisant les mêmes moyens de paiement que ceux utilisés par l’acheteur pour régler la transaction initiale dans les quatorze (14) jours à compter de la date de réception de la demande de rétractation. Toutefois, nous pourrons déférer le remboursement jusqu’au jour de la réception du produit qui fait l’objet du retour ou à réception de la preuve d’envoi du produit par l’acheteur, la date retenue étant celle du premier de ces faits. Les frais de livraison initiaux seront remboursés, à moins que vous n’ayez initialement opté pour une livraison non standard, auquel cas les frais supplémentaires ne seront alors pas remboursés.

(f)    Echanges

Vous pouvez retourner un produit acheté par l’intermédiaire de la Boutique Van Cleef & Arpels pour l’échanger contre un autre produit Van Cleef & Arpels sous réserve que le retour respecte les présentes Conditions de Vente, en particulier (a) le Droit d’Annulation et (b) le Processus de Retour ci-dessus. 

Dans tous les cas, la vente du produit retourné sera annulée et une nouvelle commande du produit devra être passée.

Si un produit est retourné à la Boutique Van Cleef & Arpels pour être échangé contre un produit moins onéreux, seul l’acheteur du produit retourné aura le droit de recevoir un remboursement de la différence de prix.

Si un produit est retourné afin de l’échanger contre un produit plus onéreux, vous devrez payer la différence de prix.

Garantie du Fabricant et vos droits légaux en tant que consommateur

Nous nous engageons à nous assurer que chaque produit soit rigoureusement conforme à nos critères de qualité et qu’il ait satisfait à tous nos contrôles, à la fois techniques et esthétiques.

Les produits sélectionnés sont couverts par la Garantie Van Cleef & Arpels applicable. Si vous souhaitez faire réparer un produit couvert par la Garantie Van Cleef & Arpels applicable, veuillez-vous référer à ladite Garantie Van Cleef & Arpels applicable et appeler notre Boutique Van Cleef & Arpels pour plus d’informations.

En votre qualité de consommateur, vous pouvez avoir des droits légaux au titre de la législation applicable régissant la vente de biens de consommation ; ces droits légaux ne sont pas affectés par les présentes Conditions de Vente ou la Garantie Van Cleef & Arpels applicable.

Services Complémentaires

Les services complémentaires suivants seront proposés gratuitement par la Boutique Van Cleef & Arpels :

a) Papier-cadeau et emballage

Toutes les commandes seront expédiées avec le coffret-cadeau Van Cleef & Arpels enveloppées dans un emballage spécial Van Cleef & Arpels, ainsi qu’avec un sac d’achat Van Cleef & Arpels (le cas échéant).

b) Gravures / embossage

La gravure et l’embossage peuvent être disponibles sur des produits particuliers et offerts uniquement par le biais de ventes opérées par l’intermédiaire de la Boutique Van Cleef & Arpels.

Si vous souhaitez faire graver ou embosser votre produit Van Cleef & Arpels, veuillez fournir les détails à la Boutique Van Cleef & Arpels.

Les commandes de produits Van Cleef & Arpels personnalisés ne peuvent pas être annulées et les produits Van Cleef & Arpels personnalisés ne peuvent pas être retournés à Van Cleef & Arpels en vue d’un échange ou d’un remboursement.

c) Echange / Réglage de bracelet

Un bracelet de montre Van Cleef & Arpels est toujours livré dans une taille standard. Pour certains produits, la taille du bracelet peut être raccourcie ou agrandie, sur demande, en appelant la Boutique Van Cleef & Arpels. Le bracelet de montre Van Cleef & Arpels est également réglable sur certains modèles de montre. Si vous demandez un réglage du bracelet de montre, les maillons retirés vous seront restitués et inclus dans le paquet à la livraison.

d) Message personnalisé

Vous pouvez personnaliser votre commande en ajoutant un message personnalisé qui sera imprimé par Van Cleef & Arpels sur une carte cadeau inclue dans votre commande. Van Cleef & Arpels se réserve le droit de rejeter tout message de cartes cadeau jugé offensant ou inapproprié, à inscrire sur le papier à en-tête Van Cleef & Arpels.

Réparations

Pour toute demande de réparation concernant un produit commandé par l’intermédiaire de la Boutique Van Cleef & Arpels, veuillez contacter notre Boutique Van Cleef & Arpels.

Limitation de responsabilité

Dans toute la mesure où la loi en vigueur le permet, nous déclinons et excluons toutes les autres modalités, conditions et garanties relatives aux produits et à la Boutique Van Cleef & Arpels, qu’elles soient explicites ou implicites ou autres, ou découlant de toute opération, usage ou pratique commerciale antérieur(e).

Aucune disposition des présentes Conditions de Vente ne limite ou n’exclut notre responsabilité en cas de responsabilité ne pouvant être limitée ou exclue de par la loi en vigueur. Sous réserve de la phrase précédente, notre responsabilité totale envers vous dans le cadre des présentes Conditions de Vente au titre de toute commande, qu’elle soit contractuelle, délictuelle (y compris du fait d’une négligence) ou autre, même si nous avons été informés de la possibilité de tels dommages, ne dépassera en aucun cas cent pour cent (100%) du prix du (des) produit(s) de votre commande.

Veuillez noter que, sous certaines juridictions, les lois relatives à la protection des consommateurs peuvent ne pas autoriser certaines exclusions ou limitation de garanties ou de responsabilités, et que par conséquent, certaines des exclusions et limitations ci-dessus peuvent ne pas s’appliquer.

Dispositions générales

Si une disposition, ou une partie d’une disposition, des présentes Conditions de Vente est jugée illégale, nulle ou non exécutoire, ladite disposition ou partie de disposition sera réputée ne pas faire partie des présentes Conditions de Vente et la légalité, la validité ou le caractère exécutoire des autres dispositions des présentes Conditions de Vente n’en sera pas affecté(e), sauf si la loi en vigueur exige le contraire.

Les présentes Conditions de Vente (et les conditions liées incorporées par référence) constituent l’intégralité de l’accord conclu entre vous et nous en ce qui concerne la commande de produits ou de services, et annulent et remplacent tous les accords antérieurs, projets d’accords, arrangements, engagements, ou contrats accessoires de quelque nature que ce soit conclus par les parties, qu’ils soient verbaux ou écrits, à l’égard de cet objet.

Nous déclinons toute responsabilité en cas d’inexécution ou de retard d’exécution ou de non-respect de nos obligations prévues par les présentes Conditions de Vente qui découlerait de toute cause hors de notre contrôle raisonnable.

Notre renonciation à faire valoir une violation de toute disposition des présentes Conditions de Vente ne saurait être interprétée comme une renonciation à faire valoir toute autre violation ou toute violation ultérieure.

Le présent contrat est conclu entre vous et nous. Nulle autre personne n’aura le droit de faire appliquer l’une quelconque de ses conditions. Toutefois, si vous achetez un produit pour un cadeau, le Destinataire de votre Cadeau bénéficiera de la Garantie Van Cleef & Arpels applicable.  

Droit et juridiction applicables

Les présentes Conditions de Vente sont régies par et interprétées conformément au droit français, sans qu’il soit fait référence à des dispositions concernant un éventuel conflit de lois. Tout(e) litige, controverse ou réclamation découlant de ou étant lié(e) aux Conditions de Vente y compris la validité, la nullité, la violation ou la résiliation des présentes Conditions de Vente, sera jugé(e) ou soumis(e) à l’arbitrage conformément aux Conditions de Vente. Si le droit français est différent du droit des consommateurs en vigueur dans votre pays, nous vous accorderons une protection similaire.

Vous pouvez engager une procédure à notre encontre soit devant les tribunaux français, soit dans le pays où vous êtes domicilié. Nous pouvons également engager une procédure à votre encontre par-devant les tribunaux du pays où vous êtes domicilié.

Sans aucune restriction à la formation de tout recours par-devant un tribunal, vous et Van Cleef & Arpels ferez tous les efforts raisonnablement possibles pendant une période de trente (30) jours pour régler à l’amiable tout litige ou tout désaccord découlant du produit ou lié à celui-ci, aux Conditions de Vente ou à tout manquement y afférent.

Si vous êtes un consommateur résidant dans l’Union Européenne, vous avez le droit de soumettre votre plainte à une institution de règlement alternatif des litiges. Vous pouvez ainsi recourir gratuitement au service de médiation MEDICYS dont nous relevons : par voie électronique : medicys-consommation.fr, ou par voie postale : MEDICYS – 73, Boulevard de Clichy 75009 Paris ou consulter la plate-forme de règlement en ligne des litiges de la Commission Européenne à l’adresse suivante : https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage, pour trouver une liste des institutions de règlement alternatif des litiges dans votre pays.
